Creation, Variation and Dissolution of Title Conditions
In most cases when purchasing or selling commercial property the buyer will simply obtain the title of the seller without variation. However, where an owner retains the neighbouring land, new title conditions may need to be created or the existing title conditions varied or discharged. This is particularly so if development is involved. For instance, if an owner is selling a plot of ground which neighbours his property, he may wish to ensure that the use of the property is controlled in some way to ensure that his own property is not affected or its value diminished. In such circumstances title conditions can be imposed on the new neighbours to ensure that their use of the land and its development is controlled. Similarly, rights of way may require to be created or existing rights of way amended. In addition title conditions requiring maintenance of mutual fences or roads can be created and existing rights discharged.
