Divorce and Family

Whether you are at the beginning of a relationship or the end of one, we understand that your family life is very important to you. Our dedicated family department will ensure that you are well looked after. You might need us to take prompt action, or prepare legal documents, or just to talk about your situation - we can help you.

How We Can Help You

Whatever the nature of your family or divorce issue, we can provide you with prompt and efficient advice so that you understand your options. We can help you with the following areas of family and divorce law:

Separation and Divorce / Dissolution

The breakdown of a relationship can be highly emotional. You may be worried about how the separation will affect your children and concerned about their future care. You might be worried about money and property. We recognise that every case is unique and we can help by offering you advice on all issues that arise in your particular case, from dealing with residence / contact arrangements for the children to negotiating or litigating complex financial disputes in order to achieve a fair division of matrimonial property. Many clients aim to reach an amicable agreement with their former spouse or partner and in most cases a negotiated settlement is achievable, sometimes with the assistance of mediation. However in some circumstances a court action is the only option and our family law solicitors have the litigation experience to deal with that on your behalf.

Grounds For Divorce In Scotland

In Scotland there is one ground for divorce - irretrievable breakdown of marriage. There are four ways in which to demonstrate that:

If the arrangements for the care of the children and / or money and property issues can be agreed it might be possible for you to enter into a separation agreement with your spouse / partner. The divorce action that follows will usually then be straightforward and you may not even have to attend court. However if you need court orders about the children and / or money or property then the court has the power to grant a variety of orders to deal with all issues as part of the divorce action, such as orders to regulate parental rights, residence / contact for the children and orders relating to money and property.

Unmarried cohabitees were given some additional rights on the breakdown of their relation when the Family Law (Scotland) Act 2006 came in to force so if that situation applies to you why not check with us and we can advise you on what your rights are?
