Licence for Works
In most cases when a Tenancy is granted the new tenant will need to carry out works to the property to make it his own. These works can range from simple decoration or the installation of shelving and units, to a complete refurbishment requiring building control and planning permissions.
Where such works are required it is important for both the Landlord and the Tenant to have a record of the works involved and also to set down a standard of workmanship and materials used. This is perhaps most important for the Landlord, who will wish to ensure that the property is not devalued by poor workmanship, and that clear written agreement is obtained of what tenant’s works he has agreed. It is also however important for the Tenant, partly again for clarity, but also to provide a record of the improvements he has carried out to the property at his own cost, which can then be used to reduce the potential for a rent increase at a subsequent rent review.
